Gold Migration Lawyers in Liquidation: How the Closure Affects Your ART Appeal

Of all the clients affected by the Gold Migration Lawyers closure, those with a live matter before the Administrative Review Tribunal (ART) are the most exposed. Gold Migration Lawyers (Gold Migration Pty Ltd, ACN 637 970 524), a Melbourne-based migration practice, emailed clients on the evening of 29 May 2026 to say it would no longer act on their matters, and ceased operating from 1 June 2026. The firm's website was deactivated and its phone line disconnected. Gold Migration Pty Ltd is now in liquidation: by a members' resolution on 1 June 2026, Ian Graham Grant of LangdonGrant was appointed liquidator. Hundreds of clients with pending matters were affected, many with no prior warning.
      
Appeal deadlines are set by law. They run on a calendar, not on whether you currently have a lawyer, and the Tribunal generally cannot extend them. How do ART deadlines actually work?
      
Most migration and refugee review applications must be lodged within a strict statutory period, commonly 28 days from the date you are taken to have received the Department's decision, and shorter in some situations such as decisions made while you are in immigration detention. Miss that window and the Tribunal usually has no power to let you in late. The right to review is simply gone. The 18 May 2026 change you need to know about
      
From 18 May 2026, under amendments commenced by Schedule 1 of the Administrative Review Tribunal and Other Legislation Amendment Act 2026, the Tribunal must decide certain temporary visa refusal reviews on the papers, that is, on the written submissions and documents alone, without an oral hearing. The government has indicated student visa refusal reviews are affected first, with scope to extend to other temporary visa refusals.

What does "on the papers" mean in practice?
      
It means the persuasive work has to happen up front and in writing. A strong on-the-papers case sets out the legal criteria, marshals the evidence against each one, addresses the Department's specific concerns, and pre-empts the obvious objections, all before any decision is made. A file that was paused mid-preparation when the firm closed is a file at risk, because no one is there to put that written case together or respond to the Tribunal's directions.

What should you do if you have an ART matter?

        - Check the date on your decision letter today. Confirm whether a lodgement or submission deadline is approaching.

        - Appoint a new representative via Form 956 so the Tribunal and the Department send correspondence to someone who is reading it.

        - Have your written case rebuilt with the on-the-papers reality in mind, complete, evidenced, and responsive to the Department's reasons.

        - Ask about hearing dates. If a hearing was already listed, your new lawyer notifies the Tribunal of the change of representative.
      
What if the deadline has already passed?
      
If an ART deadline has been missed, options narrow but are not always zero. In limited circumstances a decision may be challenged by judicial review in the Federal Circuit and Family Court, where a jurisdictional error can be shown.
