If you’re not overly familiar with the different elements of law, then the legal system can be overwhelming. This can be troublesome if you find yourself in a position where you are looking for a lawyer. What you need is information, and fast. The best way to get information? Ask the relevant questions. Do your research.

Even then, there are so many different types of law, it’s impossible for those who haven’t had years of training to know everything without getting directly in touch with somebody who has experience in the field - for example, in business you may need debt recovery (see CBL Business Lawyers debt recovery process). In all scenarios though, you must ensure that you are selecting a lawyer that is suitable for you. And to find out if that is the case, you must ask the relevant questions.

Here we have listed questions that you should ask your potential lawyer, so you can get a clearer picture of your next steps.

How viable is my case?

Lawyers can often tell you relatively quickly whether or not you have a strong case that they wish to work on. They often have an initial consultation service with prospective clients to determine whether or not they should go ahead with your case. This consultation is when you should get your main questions answered.

There are varying time limitations on cases depending on your location, which is another factor that will be taken into consideration, so if possible, act as soon as you are aware that you want to seek action regarding your situation.

How long will the case take?

Lawyers can give you an estimated time period on this but it is dependent on specific circumstances, as multiple factors contribute. It is all down to the severity and complexity of your case. Some are more straightforward than others but that can be discussed.

Do you have experience with this kind of case, and if so, how much?

This is important. You need to make an informed decision before selecting who you want to represent you. The more experience they have with your kind of case, the better. Of course, they cannot divulge into detailed tales of cases they have handled previously but they may be able to give you a broad summary to give you confidence in their abilities.

What are the costs and returns likely to be?

The money factor can be make or break for a lot of people. Whilst a lawyer won’t be able to predict an exact sum of money that you will receive or have to pay out, they could give you a broad figure to work with. A lot of lawyers work on a no win no fee basis, therefore they will only take a percentage of your compensation if you are successful.

Is there anything you need me to do?

The likelihood is that they will need evidence from you. So, make sure you keep any documents related to the case, from emails to photographs or receipts - keep everything together in an organised fashion. Particular lawyers might have set processes, of which they will inform you of.

What form of communication do you use with clients?

It’s good to go into this kind of relationship knowing how they work. Maybe they prefer emails so everything is there to reference, or they could like to meet face to face to discuss in more depth. By learning this, you can gather if they are suited to you. For example, if they did want to do most of the liaising in person, you would need to be local to where they practice for it to function smoothly.

If you are unsure of something it is always better to ask than to wonder or assume. Write the important responses down and keep on top of everything.
