Choosing a trademark, which can be a name, phrase, word, symbol or product (or combo thereof) that represents your business, can be tricky business. Learning how to trademark your business is simple. Just follow these steps and you should do just fine.


Trademark Research


The first step for learning how to trademark your brand is to do tons of research. You can do this on your own or use the help of a trademark attorney. With an attorney, you can receive legal advice regarding the trademark that you're interested in using. For instance, if the lawyer finds that your name or symbol is too similar to another business's trademark then he or she may advise you against using it. You should avoid using anything too similar to other business's trademarks, so that you won't have any problems in the future. This especially goes for businesses that sells the same products or services as yours. You can go to the USPTO web site and use its TESS database to research designs and words/names/phrases. It will detail whether the trademark has an application that is pending, approved, dead, abandoned or expired. If you find the one that you want that has an application that is one of the latter three, then you can go ahead and file your application for the trademark.


Online Trademark Application


Once you have researched the trademark that you would like to use, you can fill out an application online at the USPTO web site. To ensure that your application gets approved, you can use a trademark attorney to do the research for you to make sure that your trademark meets the requirements of the USPTO. You have to be using the trademark for commerce purposes and not simply registering it to own it. So you must use the trademark for your services or products. An attorney can give you direction on how the trademark business works.


Trademark Registration


After your trademark has been registered, it will last for about ten years. There are periodic requirements that must be met to keep your trademark registered. Since trademarks are territorial, it will only be effective in the United States. However, you're able to file an “International Application”, which will allow you to register your trademark across seas. Before you're able to do this, you must have a qualified application pending or approved. It usually costs a couple hundred dollars to have your trademark registered, and depending on where you live, it can be around $1,500 to receive assistance from a trademark attorney.


Now that you understand how to trademark your business's brand, you should have no problems getting everything sorted out. Until you have registered your trademark, you can use the common law rights to protect your logos, business name and/or product.

Having been in business since the age of 11 Merlin never “had time for school” finding his teachers uninspiring and limited. He formed his first company at 17 that evolved into what is now a successful domain investment company, commanding 7 figure annual profits.

 

Then came Soothe in 2013, created out of the frustration of not being able to book a last minute massage, when you need it most. Equipped with an OPM from Harvard Business School, and always quick to embrace new technology, Merlin saw the opportunity within the “on- demand” economy and has managed, in his terms to “democratise massage”. This means making massage more accessible to more users - customers can book a massage at a time that works for them, while the therapists can enjoy a new sense of independence, creating their own schedule.

 

Travelling extensively came with the territory, as Soothe rapidly expanded, now into 53 cities around the globe. This can have a marked effect on the body, physically, mentally and emotionally. I asked Merlin to explain how he balances his health, while building his business, managing his staff and prioritising his time.

 

Follow Merlin’s Top Tips for a Healthy Work-Life-Balance

 

  1. The key to a great company is in the team. Delegate as much as possible, and develop trust in your team. It’s important to know when micro-management becomes counter-productive.

  2. Manage your day putting yourself at the top of the priority list. Merlin runs a few kilometres everyday and stays off his laptop when he can. Massage is his mediation so he gets one, weekly. Merlin believes that if you stay healthy and self-nurtured, the rest will follow. It becomes contagious!

  3. Merlin advises us to maintain a healthy perspective of self. “Don’t have an over-inflated sense of self importance around your involvement in a business” he says. Allow and trust those around you to shine.

  4. Time is worth more than money for our generation; reward them with it.

  5. There are no politics in the Soothe offices. Every person who goes for an interview meets a top manager. They practice a ‘flat management’ structure, and dogs are encouraged to come to work. Merlin’s beloved pooch is always there to welcome them!

  6. Purpose is everything, and a major motivator. Merlin receives thank you messages from Soothe therapists around the world regularly, who have managed to change their lives as a result of the new on-demand app and the freedom it has given them.
