How To Make A Personal Injury Claim

  • Written by Daily Bulletin

If you or somebody close to you has recently been injured recently whether in a car accident or at work, you may be entitled to compensation. To find out whether you are eligible for compensation and should begin the process of making a personal injury claim, speak with an insurance claim management provider or a legal specialist such as a Portland Workers Compensation Attorney, who can guide you in the right direction.

For those who are ready to make a claim, here are some of the most important facts you should know to ensure you receive the compensation you deserve.

The different types of personal injury claims

There are 3 different types of personal injury claims, these cover motor accident claims, work-related injury claims, and medical negligence.

Across Australia, there are various rules and regulations for how compensation is awarded to those making a claim. However, if you have suffered as a result of an accident, with an injury, loss of income, or have incurred medical expenses, you are likely elgibile for compensation. It is to speak with a legal specialist who can advise whether you would be eligible for any compensation and how much this could potentially be for.

Steps to take when making a claim

Notify the relevant people

If you have sustained an injury as a result of an accident at work or during a road traffic accident, make sure the relevant authorities are aware of the injury(s) you have sustained. For example, if you have suffered an injury at the scene of a car accident, the police or attending paramedics must be made aware. Both so they can support you in the initial stages of treatment, but also so there is a record made of the injury. From the police, you must obtain a Traffic Incident Number, which will later be used during the claim process.

Gather the necessary medical documents

Speak with your doctor to obtain all the documentation disclosing the details of your injury and the medical expenses you have incurred as a result of your treatment. This information can be used as evidence during the claim process.

Seek legal advice from experts

It is always highly recommended to speak with a legal professional when making a personal injury claim. Whether you are lodging your claim against your workplace, through the motor insurance company, or public authority, a lawyer will be able to provide you support and guidance.

A personal injury specialist can ensure you are aware of your legal rights, and the potential compensation amount you are owed, plus details on how long the claim process may take.

You should be aware that, although you may have all the relevant information and a favourable case for compensation, the process can still take up to 28 business days. The final decision on your personal injury claim will be received in the form of a rejection or acceptance letter, addressed to the claimant. If your claim is not successful, your lawyer can support you in the next steps.
